Referral and Affiliate Program Terms

These terms are part of the Terms and Conditions. Section 22 of the Terms summarises them. Where the two differ, this page controls for the Referral Programs.

1. Who this is for

Two different things are covered here:

The Referral Program, open to Users who introduce a family or a professional to BirthBridge.
The Affiliate Program, for people who promote BirthBridge to an audience — creators, educators, community organizations, and businesses.

You must have an account in good standing, and you must be at least 18 or the age of majority where you live.

2. What is rewarded, and what is not

A reward is for introducing someone to BirthBridge. That is the whole basis of it.

A reward is never:

A payment for steering a family to a particular professional.
A payment from a professional to us, or from us to a professional, for sending clients their way.
A commission on the price of anyone's care.

We say this in three places because it matters legally and not only ethically. Paying for patient referrals is regulated, and in some circumstances prohibited, in both the United States and Canada. See Section 7.

3. How a reward is earned

You get a personal link or code. Rewards are tracked through it.
A referral counts when the person you introduced creates an account through your link and completes the qualifying step shown in your dashboard at the time.
The qualifying step, the reward amount, and any cap are shown in your account. They can change, and the terms that apply are the ones displayed when the referral was made.
Rewards are confirmed after a holding period, so that we can check for fraud and account for cancellations.
Self-referrals do not count. You cannot refer yourself, a second account you control, or a household member sharing your payment method.

Payment. Confirmed rewards are paid through our payment processor to the account you connect. You are responsible for your own taxes on anything you receive, and we may need tax information from you before we can pay. Where we are required to report payments to a tax authority, we will.

4. Disclosure — the part that is not optional

If you promote BirthBridge and you can earn something from it, you must say so, clearly, wherever you make the recommendation.

This is a legal requirement, not a preference. In the United States the FTC's Endorsement Guides and its Rule on Consumer Reviews and Testimonials require that a material connection be disclosed clearly and prominently. In Canada, the Competition Act's provisions on false or misleading representations do the same, and the Competition Bureau has been explicit that undisclosed paid endorsements are reviewable conduct.

How to do it properly:

Disclose in the same language as the recommendation	Disclose in English on a French or Spanish post

If a platform gives you a built-in paid-partnership label, use it — and still say it in your own words too. The built-in label alone is not treated as sufficient.

5. What you may say

Only recommend what you actually believe, based on real experience. If you have not used BirthBridge, do not say you have.

Do not make claims about:

Health, safety, or birth outcomes. Not yours, not anyone's.
What a professional will do for someone, or how their birth will go.
Whether anyone on BirthBridge is screened, vetted, verified, licensed, insured, or safe. Our Trust and Safety Policy sets out exactly what we check, and it is less than most people assume. Do not describe it as more.
Prices, availability, or coverage you have not confirmed.

Do not speak for BirthBridge. You are not our employee, agent, partner, or spokesperson, and you may not say or imply that you are. Do not answer questions as though you were our support team, and do not create accounts, pages, or handles that look like ours.

Our name and logo. You may say you recommend BirthBridge and link to us. You may not use our name or logo as your own branding, register a domain or handle containing our name, or bid on our brand name in paid search, without our written permission.

6. What is not allowed

Creating accounts to claim your own reward, or coordinating with someone else to do it.
Enrolling anyone without their knowledge, or entering someone else's details.
Unsolicited commercial messages — bulk email, cold DMs, texts, or messages to people who did not ask to hear from you. See Section 7 for Canada.
Spam, misleading claims, clickbait, or fake urgency.
Promoting BirthBridge alongside content that is unlawful, hateful, sexual, or aimed at children.
Buying, selling, or trading referral links or codes.
Interfering with tracking, including cookie stuffing and forced clicks.

Consequences. Rewards obtained through any of this are forfeited and may be reclaimed. We may remove you from the program and, for serious or repeated conduct, close your account. Section 14 of the Terms applies, including your right to be told why and to respond.

7. Rules that apply to you directly

Two areas where the obligation is yours, not ours, and where the penalties are real.

Canada's Anti-Spam Legislation

If you send any commercial electronic message to someone in Canada to promote BirthBridge — email, text, DM, or anything similar — CASL applies to you. It requires consent before you send, not an opt-out afterwards. Every message must identify you, give your mailing address and a way to reach you, and include an unsubscribe mechanism that works for at least 60 days, honoured within 10 business days. Penalties reach CAD $10 million for an organization, and directors and officers can be personally liable.

Do not send unsolicited commercial messages to anyone in Canada.

Government health programs

If you are a health care professional, or you refer people to one, be aware that paying or receiving anything of value for referring patients whose care is paid for by a government health program is regulated, and in the United States is a criminal matter under the federal Anti-Kickback Statute. Canadian provinces have comparable restrictions on fee splitting and referral fees, and regulatory colleges have their own rules.

Our program pays for introductions to BirthBridge, not for patient referrals, and we have structured it that way deliberately. But if you bill Medicaid, Medicare, a provincial health plan, or any other government health program, or you are a regulated health professional subject to a college's rules on referrals or advertising:

Tell us at hello@mybirthbridge.com before you take part.
Check your own obligations with a lawyer or with your regulator first.
Your professional obligations override this program. If your college prohibits something here, follow your college.

8. Your information

We collect your referral code, who you introduced, and what has been earned and paid, as described in Section 2.1 of our Privacy Policy. Payout details are held by our payment processor.

We do not tell the person you referred what you earned, and we do not give you their personal information. You see that a referral qualified, not what they did on the platform.

9. Changing or ending the program

We may change, suspend, or end either program at any time, on notice through the Platform.

Rewards already earned and confirmed before a change are not affected. If we end a program, we will tell you and give a reasonable window to claim rewards already earned.

You can leave at any time. Leaving does not affect confirmed rewards.

10. General

Nothing here creates an employment, agency, partnership, or joint venture relationship.
These programs are void where prohibited by law.
Sections 15 to 20 of the Terms apply, including the disclaimers, the limitation of liability, and dispute resolution. Schedule B of the Terms applies if you are in Canada, including that you are not required to arbitrate.
